1. Scope
These General Terms and Conditions apply to the use of our website and to all orders placed through our online store by consumers and entrepreneurs.

A consumer is any natural person acting for purposes outside their trade, business, or profession (hereinafter referred to as “the Consumer”). An entrepreneur is a natural person or legal entity or legal entity without legal personality (such as a general partnership, limited partnership, or partnership) that, when concluding a legal transaction, acts in the exercise of their commercial or independent professional activity (hereinafter referred to as “the Entrepreneur”).

The webshop is operated by MNC Outlet.

With respect to Merchants, these General Terms and Conditions also apply to future business relationships, without us having to invoke them again. If the Merchant uses conflicting or supplementary general terms and conditions, their validity will be disputed; they will only form part of the agreement if we have expressly agreed to them.

Our data protection declaration, including the description of the type, scope, and purpose of the collection and processing of personal data, is also an integral part of these General Terms and Conditions.

We strive to ensure that our website is available to you uninterruptedly, within the limits of technical capabilities. However, for maintenance, security, or capacity reasons, the website may be interrupted or temporarily discontinued for short periods. Therefore, continuous availability of the website cannot be guaranteed for technical reasons.

2. Contractual partner, point at which the agreement is concluded
The purchase agreement is concluded with MNC Outlet.

The presentation of the products in the online shop does not constitute a legally binding offer, but rather a non-binding online catalog. You can initially place our products in your shopping cart without obligation and correct your information at any time before submitting your binding order by using the correction tools provided and explained during the ordering process. By clicking the order button, you place a binding order for the products in your shopping cart.

Immediately after submitting your order by email, you will receive an order confirmation (the so-called order confirmation).

Purchasing Software Keys

In our online store, you can purchase specific computer game products in digital format. These are specifically software keys or codes used in connection with the activation and use of software (a computer game) you already own. The software keys are provided to you before first use. In this case, the subject of the agreement is the permanent transfer of the software keys made available for download and the granting of the associated usage rights. These are governed by the respective general terms and conditions and/or license terms of the product manufacturer, which apply in addition. The purchase agreement for the software keys is concluded upon full payment by credit card.

Purchasing MNC Outlet Gift Cards

In our online store, you can order gift cards with a value ranging from €5.00 to a maximum of €500.00. To do so, you must provide the purchaser’s name, billing and credit card information, email address, and the name and email address of the gift recipient. The order will be processed and the online gift card will be emailed free of charge within 24 hours. All prices are in euros. The purchase agreement for the gift card is concluded upon full payment by credit card.

3. Language and Storage of the Agreement
The language of the agreement is English.

We will store the text of the agreement and send you the order information and our Terms and Conditions by email. You can view the text of the agreement in our customer login.

4. Registration, Customer Account
In our webshop, you have the option to register and create a customer account. The customer account is personalized, so you must choose a custom password. We ask that you keep your password secret at all times and carefully protect access to your customer account. In particular, we cannot accept any liability for activities carried out using your customer account.

5. Delivery Terms
When placing an order, shipping costs will be added to the displayed product prices. You can find more information about shipping costs here and in the individual offers.

6. Payment
You can pay in our webshop using the following methods:

Credit Card

We accept Visa and Mastercard/Eurocard credit cards. When you place your order, you also provide us with your credit card information. After you have verified your identity as the legitimate cardholder, we will only request your credit card company to initiate the payment transaction once the products have been shipped. In most cases, the card will not be charged immediately, but only after a period of time, depending on the issuer of the credit card company in question.

iDEAL

iDEAL is a direct online transfer from your bank account to MNC Outlet’s bank account. You don’t need to register or sign up for the service. You can use iDEAL immediately if you are a customer of one of the participating banks. iDEAL is secure because you pay within your own bank’s online banking environment. iDEAL is convenient because all payment details are automatically pre-filled, and you know immediately whether your payment was successful or not. You maintain control over your balance; the iDEAL payment is immediately visible on your account overview.

At the MNC Outlet checkout, you first need to select the iDEAL payment option, then select your bank and enter your full name.

You will then be directed to your bank’s online payment section where you must log in and confirm the payment.

Once you have confirmed the payment, you will return to the MNC Outlet website on the order confirmation page.

Apple Pay

To pay the invoice amount via the payment service provider Apple Inc., One Apple Park Way, Cupertino, CA 95014, USA (“Apple”), you must use the “Safari” browser, be registered with Apple, have activated the Apple Pay function, authenticate yourself with your access data, and confirm the payment order. The payment transaction will be processed immediately after placing the order. You will receive further instructions during the ordering process.

Google Pay

To pay the invoice amount via the payment service provider Google Ireland Ltd., Gordon House, Barrow Street, Dublin 4, Ireland (“Google”), you must be registered with Google, have activated the Google Pay function, authenticate yourself with your access data, and confirm the payment order. The payment transaction will be processed immediately after placing the order. You will receive further instructions during the ordering process.

Stripe Link

In partnership with Stripe Payments Europe, Limited (SPEL), 1 Grand Canal Street Lower, Grand Canal Dock, Dublin, D02 H210, Ireland (“Stripe”), we offer you the option to pay easily and securely with just one click via Stripe Link. To pay via Stripe Link, you simply enter your payment details with Stripe. If you choose this option, a Stripe Link account will be created and your payment information will be stored. For future orders, you can identify yourself with a one-time password (OTP) to quickly complete the payment without having to re-enter your payment details. You will receive further instructions during the checkout process.

Payment with MNC Outlet Gift Cards

The Gift Card can only be used to purchase goods at MNC Outlet.

If the purchase price exceeds the value of the gift card, the customer must pay the difference. If the purchase amount is less than the value of the gift card, the remaining balance will remain on the gift card and can be redeemed for a future purchase at a later date. In the event of a chargeback/revocation, the purchase amount will be credited to the gift card used. Therefore, always keep your gift card. This also applies if two payment methods are combined. The gift card is transferable and has no expiration date. The card balance cannot be redeemed for cash. No interest is paid on the accumulated amount. The card balance can be checked at any MNC Outlet Superstore (branch) in the Netherlands or online at https://www.MNCOutlet.com. The gift card issuer is MNC Outlet.

7. Click & Collect
If you choose the “Click & Collect” option, the products will be ready for collection at the store of your choice within 1 hour if you place your order before 6:00 PM on weekdays. Orders received after 6:00 PM or on Sundays and public holidays can be collected the following business day from 10:00 AM.

You will be notified by email as soon as the products are ready (collection notification). From the moment the collection notification is received, you can collect the products during store opening hours on the same day or within the following 5 days.

To collect the products, you will need the collection notification and valid photo ID. Once you have successfully collected your ordered items, you will receive a collection confirmation and your invoice by email.

If the products are not collected, the reservation will be cancelled and the cancellation of the item(s) will be initiated. In that case, the reservation will be canceled according to the chosen payment method, or the amount paid will be refunded. Delivery via the “Click & Collect” option is free.

8. Pre-order
You can use our pre-order service in accordance with the terms below to order the product now and receive it when it is in stock.

When you place your order, you will be asked to provide your payment information. For credit card payments, the amount will be pre-authorized at that time and then debited after shipment, or for Click & Collect orders, after collection of the products. If we are unable to authorize your payment information, we will send you an email requesting that you re-enter it. Re-entry must take place within 24 hours of sending the email so that we can hold your order. After placing your order, you will receive confirmation of your pre-order details by email. You will receive an email notification when your pre-ordered products have been shipped or are ready for collection at your selected store (Click & Collect orders). If you use our pre-order service, you’ll pay the lower price if our price on the day of pickup or shipping is lower than the price at the time of order. When using our pre-order service, payment with a gift card or purchase on account via Klarna is not possible.

9. Right of Withdrawal
Consumers are entitled to the statutory right of withdrawal as described in the withdrawal policy. Businesses are not entitled to a (voluntary) right of withdrawal.

10. Retention of Title
The products remain our property until full payment has been received.

11. Transport Damage
The following applies to consumers: If products are delivered with obvious transport damage, we request that you report these defects to the carrier as soon as possible and contact us immediately. Failure to file a complaint or contact us will not affect your statutory claims (in particular your warranty rights) and their enforcement. However, they do help us assert our own claims against the carrier or the transport insurance.

The following applies to Entrepreneurs: The risk of accidental loss and accidental deterioration passes to you as soon as we have delivered the product to the forwarder, carrier, or other person or institution designated to carry out the shipment. Merchants are subject to the inspection and notification obligation. If you fail to provide the notification stipulated therein, the goods are deemed to have been approved, unless the defect was not recognizable upon inspection. This does not apply if we have fraudulently concealed a defect.

12. Warranty and Guarantees
The statutory provisions regarding liability for defects apply. Information about any additional warranties and their exact terms can be found with the product and on special information pages in the online shop.

13. Liability
Claims for damages are excluded, unless otherwise stated below.

We are always liable without limitation for claims based on damage caused by us, our legal representatives, or vicarious agents:

in the event of injury to life, limb, or health

in the event of intentional or grossly negligent breach of duty

in the event of warranty promises, if agreed upon, or

insofar as product liability law applies.

In the event of a breach of material contractual obligations, the fulfillment of which is a prerequisite for the proper performance of the contract and on whose compliance the contractual partner may reasonably rely (core obligations), due to slight negligence on the part of us, our legal representatives, or vicarious agents, the amount of liability is limited to the damage foreseeable at the time of conclusion of the contract, the occurrence of which could reasonably be expected (causal link).

14. Industrial Property Rights
Programs, designs, writings, and databases of MNC Outlet are protected by copyright. Any use outside of the website is prohibited without the express permission of MNC Outlet.

All rights relating to the offer and the respective designations used therein, including all trademark and patent rights, copyrights, or licensing rights, are the exclusive property of MNC Outlet.

15. Sales to Minors
We do not offer products for purchase by minors. Our products can only be purchased in our webshop by customers of legal age. Orders by minors are only possible with the cooperation and consent of a legal representative.

16. Final Provisions
Dutch law applies to consumers, excluding the UN Convention on Contracts for the International Sale of Goods, insofar as the protection afforded by mandatory provisions of the law of the state of the consumer’s habitual residence is not thereby withdrawn (beneficial right principle).

If you are a business owner, exclusively Irish law applies, excluding the United Nations Convention on Contracts for the International Sale of Goods. The sole jurisdiction for orders placed by merchants, (public) legal entities, or public special funds is Galway, Ireland.

If individual clauses are wholly or partially invalid or lose their validity at a later date, this shall not affect the validity of the remaining terms. However, if this would be unreasonably onerous for one of the contracting parties, the entire agreement shall become invalid.
